The meeting was called to order by Chairman Sharon Lee Carey at 5:15 p.m. Commissioners present: Roy Moore, Cheryl Ford. Commissioners absent: Linda Ochs, Steve Iverson. Staff present: Secretary Cary Baker, Acting City Planner Stacy Chase. Public present: 1.

No one is present under the public forum.

MOTION by Commissioner Moore, SECONDED by Commissioner Ford to approve the minutes of the June 16, 2005 meeting. ALL AYES.

PUBLIC HEARING: John & Kelly Bagwell are requesting the Planning Commission to approve and recommend to the City Council the abandonment of the alley way in APN 001-054-01 & 02. The property is located east of Juniper Street Between 14th Street & 15th Street The project is located in the Alturas Heights Addition, Parcel Numbers 001-054-01 and 001-054-02.

The Bagwells are requesting an abandonment of an alleyway located in the 054 block of the Alturas Heights subdivision. The 054 block is contained by 15th Street to the north end, 14th Street to the south end, Pine Street on the east side, and Juniper Street on the west side. The Bagwells own the property bordering both sides of the alleyway. At present time, the alleyway is non-existent and the owner of the property desires to develop his property and does not want an alleyway running through the middle of his project.

Staff recommends the approval of the alleyway abandonment with the following condition: 1) the abandoned alleyway shall be merged with the adjacent lots. This process will require a title report, survey, new deeds and signature/consent of lenders, if any. The proposed project will remain accessible on all four sides and alleyway access will not be necessary for such things as fire protection or access to publicly provided services.

There were no written or oral comments received from the public.

MOTION by Commissioner Ford, SECONDED by Commissioner Moore that the Commission finds that the abandonment is in conformity with the City’s General Plan and makes a recommendation to the City Council to consider approving the abandonment by resolution at their next regular meeting. ALL AYES.

PUBLIC HEARING: Pattie Manzer is requesting a Home Occupation Permit that will allow her to operate a massage and nutritional counseling business in her home. Proposed hours are variable by appointment only. The project is located in the Council Crest Addition, Block 025, at 307 N. West Street

The property has a General Plan zoning designation of Medium Density Residential. The proposed project is a permitted use in subsection 217 – Home Occupations.

The project location includes 125’ of frontage on N. West Street and 54’ on 4th Street. Approximately 24’ of the West Street frontage is utilized by a driveway. All of the 4th Street frontage and 100’ of the West Street frontage is available for parking. This would allow parking for 6 vehicles. The home has an existing handicap access to the front door. As many as 5 clients at a time are anticipated. This should not create a markedly noticeable increase in traffic flows.

One comment was received in person from Mr. Bill Clark, neighbor on 4th Street, he was highly supportive of the project.

Based on the facts presented on this project, staff recommends the Planning Commission approve the Home Occupation Permit for Ms. Manzer.

MOTION by Commissioner Moore, SECONDED by Commissioner Ford to approve the Home Occupation Permit for Patti Manzer to operate a massage and nutritional counseling business in her home at 307 N. West Street. ALL AYES.

PUBLIC HEARING: Donald Roy is requesting a Home Occupation Permit that will allow him to have a lawyer’s office in his home. Proposed hours of operation is Monday through Saturday 8 a.m. to 5 p.m. The project is located in the Woodland Terrace Addition, Block 026, at 1603 N. East Street. The property has a General Plan zoning designation of Medium Density Residential (R2) and is a permitted use under the City of Alturas Zoning Ordinance, subsection 217 Home Occupations.

The proposed project location includes 123 feet of frontage on N. East Street and 118 feet on 16th Street. Approximately 24 feet of the East Street frontage is utilized by a driveway. All of the 16th Street frontage and 100 feet of the East Street frontage is available for parking. As many as 3 clients at a time are anticipated. This should not create a markedly noticeable increase in traffic flows.

There were no written or oral comments received from the public.

Based on the facts presented on this project, staff recommends the Planning Commission approve the Home Occupation Permit for Mr. Roy.

MOTION by Commissioner Ford, SECONDED by Commissioner Moore to approve the Home Occupation Permit for Donald Roy to operate a lawyer’s office at 1603 N. East Street. ALL AYES.

STAFF REPORTS: Acting Planning Director Stacy Chase reports that Rite Aid is moving along as scheduled; they hope to be open in November.

With no further business to come before the Commission, meeting adjourned at 5:35 p.m.
